Rulemaking at CDPS
The Colorado Department of Public Safety is committed to governmental transparency in our stakeholder engagement and to comply with the provisions of the State Administrative Procedure Act, Section 24-4-101, et seq., of the Colorado Revised Statutes for rulemaking and regulatory procedures.
Stakeholder Engagement and Accessibility
The process of adopting, reviewing, and changing rules and regulations is a public one. We encourage your participation in our rulemaking process. Please see the information below for upcoming rulemaking hearings and how to submit comments. You are always welcome to attend any hearings associated with the rulemaking process, and your comments and questions will be taken into consideration during the rulemaking process.

Rulemaking Updates and Public Hearings
Proposed and completed rulemaking for the calendar year are listed below. Stakeholder notices include drafts of the the proposed new or amended rules along with invitations and information for stakeholder and public comments. Upcoming rulemaking hearing announcements include the draft of the proposed rules, information on the meeting time, date and virtual platform/link (hearings are held virtually unless otherwise noted), and invitation to submit comments before the hearing. Completed rulemaking hearings include the adopted rules, hearing exhibits, and hearing information. Rulemaking hearings are held to review and to update rules and regulations to remain consist with Colorado statutes, Code of Federal Regulations (CFR) and/or national criteria.

Proposed Rulemaking
8 CCR 1507-101 Building and Fire Code Adoption and Certification of Inspectors for Fire & Life Safety Programs Administered by the State of Colorado
The Division of Fire Prevention and Control will begin the rulemaking process to amend 8 CCR 1507-101 Building and Fire Code Adoption and Certification of Inspectors for Fire & Life Safety Programs Administered by the State of Colorado to establish minimum codes and statndards for fire safety and prevention related to the operation of mobile food establishments, as defined in Section 29-11.6-102 (6), C.R.S., for use by a local government in the local government's establishment or adoption of a fire code.
The public rule hearing time and date will be posted on this webpage as soon as determined. A redlined draft of the proposed amended rules will also be posted upon filing notice of rulemaking with the Secretary of State and with the Department of Regulatory Agencies (DORA). The public hearing will be held virtually via the Google meet platform. Anyone needing accessibility accommodation to attend the meeting or to access the proposed amended rules may contact CDPS Rules Administrator, Chris Moreno, no later than October 15, 2025 at christine.moreno@state.co.us or by phone at 719-343-0995.
We welcome public comments from stakeholders and any interested parties. Comments may be submitted prior to the public hearing to the DFPC Fire and Life Safety Section at cdps_dfpc_flsa@state.co.us or to CDPS Rules Administrator, Chris Moreno, at christine.moreno@state.co.us. All stakeholder comments become part of the rulemaking record. Prehearing exhibits will be available on the website no later than three (3) days prior to the public hearing.
Upcoming Public Hearings
8 CCR 1507-31 Building, Fire, and Life Safety Code Enforcement and Certification of Inspectors for Health Facilities Licensed by the State of Colorado [Continuation of Rulemaking] - Friday, October 31, 2025 10:00AM MDT
The Division of Fire Prevention and Control is in the continuance rulemaking process and is holding a second public hearing to adopt amended rules related to code enforcement and inspection of licensed health care facilities in Colorado. This hearing will be held virtually using the Google meet platform.
This hearing is a continuance of rulemaking to adopt proposed amended rules as presented in a public hearing on September 17, 2025. The rules presented were not adopted by the Division Director and rulemaking was continued with the proposed updated amended rules found in this notice and published in the Colorado Register.
The Office of State Planning and Budgeting reviewed the proposed amended rules and the proposed fee changes. Permission to continue rulemaking was granted with revisions to the initial proposed fee changes approved on September 22, 2025.

The purpose of the rules amendment is several-fold. First, the amendments include fee increases related to inspections and plan reviews in order for the Division to defray the anticipated costs of the program. Second, the amendments add the ability of the Division and other Authorities Having Jurisdiction (AHJ) to allow the use of Special Inspectors to perform certain inspections when necessary and also clarifies the duties of the Special Inspector. Third, the amendments clarify the roles of local building departments, fire departments, and the Division as they relate to licensed healthcare facilities in Colorado. Fourth, the amendments change clarifies the Division's permit application process and adds mandatory reporting requirements for certain occurrences. Fifth, the amendments change the title from "third-party inspector" to "delegated building inspector" to align with divisional building code rules. Sixth, the amendments update definitions and Division contact information as well as correcting minor grammatical and formatting errors.
These rules are under the statutory authority of Sections 24-33.5-1201, 24-33.5-1203, 24-33.5-1204.5, 24-33.5-1206, Colorado Revised Statutes (C.R.S.).

8 CCR 1507-75 First Responder Death Benefit Fund - Wednesday, November 5, 2025 1:30 PM MST
The Executive Director's Office is holding a public hearing to adopt new rules regarding the newly created First Responder Death Benefit Fund. This fund was created in §24-33.5-122, C.R.S. in SB 25-310, modifying and enacting the implementation of Proposition 130, which was approved by Colorado voters at the Novemeber 2024 statewide election. The proposition provides a $1 million death benefit to the family of a first responder who is killed in the line of duty.

Most rules and regulations exist at the direction of the state legislature in order to regulate certain business and personal activities.
